What Is an Estate Plan?
An estate plan is a set of legal documents that explains how your assets will be managed and distributed, who will make financial and medical decisions if you cannot, and how your family will be cared for in the future.
What Should an Estate Plan Include?
Below are some essential components of a proper estate plan:
Will
A will specifies how your assets will be distributed and designates guardians for any minor children.
Trusts
Trusts can help you manage assets, minimize taxes, and provide for beneficiaries over time.
Power of Attorney (POA)
A POA authorizes a trusted individual to make legal, financial, or medical decisions on your behalf if something should happen to you.
Advance Healthcare Directive
An advance healthcare directive or “living will” specifies your wishes regarding life-sustaining treatment, end-of-life care, and other critical medical decisions.
Types of Trusts We Handle
Below are some common types of trusts we assist with:
- Living trusts. Manage your assets during your lifetime and distribute them after death.
- Irrevocable trusts. Provide strong asset protection and potential tax advantages.
- Special needs trusts. Provide for a loved one with special needs without affecting their eligibility for government benefits.
- Charitable trusts. Create a lasting legacy by supporting the causes you care about.
- Decedent’s trusts. Provide for your beneficiaries after your death.
- Generation-skipping trusts. Transfer assets to grandchildren and bypass the immediate next generation to minimize taxes.
- Pet trusts. Provide care for your pets after you pass away.
Types of Powers of Attorney (POAs)
Establishing a power of attorney (POA) is a crucial part of estate planning. This legal document allows you to appoint a trusted individual (known as the “agent” or “attorney-in-fact”) to make decisions on your behalf in legal, financial, or medical matters if you become unable to do so yourself.
Common types of POAs include:
Durable Power of Attorney
A durable POA provides legal authority to manage your money and property if you cannot do so, such as paying mortgages, filing taxes, or managing bank accounts. A “durable” POA means it stays in effect even if you become mentally incapacitated.
Medical Power of Attorney
A medical power of attorney (MPOA) allows the agent to make medical decisions on your behalf if you cannot communicate them yourself. It only takes effect when a provider certifies in writing that you lack the capacity to make your own healthcare decisions.
Statutory Durable Power of Attorney
A statutory durable power of attorney (SDPOA) grants legal and financial decision-making authority. It does not authorize the agent to make medical-related decisions. Its standardization in Tex. Estates Code § 752.051 means state banks and financial institutions are legally required to accept it and are less likely to challenge the agent’s authority during a crisis.
Important Considerations for Estate Planning
Effective estate planning involves more than drafting documents; it also requires thoughtful decisions about your family, finances, and long-term goals. Some key considerations include:
- Asset distribution over time. Deciding who will inherit your assets and whether distributions should occur immediately or over time based on your family’s needs.
- Planning for children and dependents. Deciding when and how children receive an inheritance.
- Tax-aware wealth strategies. Evaluating gifting options and other tax-reduction strategies that align with your financial objectives.
- Business succession planning. Creating a clear plan for the transition, sale, or continuation of a closely held business to preserve value and reduce disruption.
- Charitable and philanthropic goals. Incorporating charitable giving that reflects your values while supporting broader planning objectives.
- Incapacity planning. Selecting trusted individuals to make financial, legal, or medical decisions if you are unable to do so yourself.
- Choosing fiduciaries. Appointing executors, trustees, and guardians who can responsibly carry out your wishes and manage complex responsibilities.
- Protecting beneficiaries. Using planning tools to safeguard assets from creditors, poor spending habits, or external risks.
- Managing retirement and qualified accounts. Coordinating IRAs, 401(k)s, and other qualified assets with beneficiary designations and overall estate strategy.
These are just some of the decisions faced by individuals and families when planning for the future. We work closely with clients to navigate both the legal and emotional aspects of estate planning and provide practical guidance tailored to your circumstances.
Benefits of Having a Comprehensive Estate Plan
Without a well-structured estate plan, your loved ones may face confusion, legal challenges, and emotional stress during an already difficult time. We can help you create an estate plan that provides clarity and peace of mind for your family.
